SCR 2.091 Special Testing Accommodations

         For the purposes of this rule, "disability" shall be defined as in the Americans with Disabilities Act and shall be subject to the exclusions provided in the Americans with Disabilities Act. "Disability" with respect to an individual shall mean (a) a physical or mental impairment that substantially limits one or more major life activities of such individual; (b) a record of having such an impairment or; (c) being regarded as having such an impairment.

        (1) The bar examination shall be administered by the Bar Examining authority to all eligible applicants in a manner that is fair and equitable.

        (2) Persons needing special accommodations on the examination should make written request to the Board to obtain the necessary forms and procedures within 30 days of the application filing deadline. Appropriate current documentation may be required by the Board.

        (3) The Bar Examining authority shall, upon written request of an applicant with a disability, make reasonable modifications in the manner in which the examination is administered to an applicant, including the provision of auxiliary aids and services, while maintaining the security and integrity of the examination.

        (4) An emergency request for special accommodations may be filed after the prescribed deadlines stated above if the applicant did not have the disability at the time of filing the application to take the bar examination.
